These Terms apply to all users of the Service, including recruiters, staffing agencies, employers, candidates, and any other individuals or entities who access or use our platform.

2. Description of Service

RecruitIQ is a recruiting and applicant tracking platform that enables staffing agencies and employers to post jobs, manage applications, track candidates, and streamline the hiring process. Our Service includes web-based software, mobile applications, and related services.

3. Account Registration and Security

3.1 Account Creation

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Account Eligibility

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws or regulations
  • Post false, misleading, or fraudulent job listings or candidate information
  • Harass, abuse, or harm other users or candidates
  • Violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Transmit any viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service without our express written permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Collect or harvest information about other users without their consent
  • Use the Service to discriminate against candidates based on protected characteristics such as race, gender, age, religion, or disability

5. Job Postings and Candidate Information

5.1 Job Postings

You are solely responsible for the content of job postings you create. You warrant that all job postings are accurate, comply with applicable employment laws, and do not discriminate against protected classes. We reserve the right to remove any job posting that violates these Terms or applicable laws.

5.2 Candidate Data

You are responsible for ensuring you have the legal right to collect, store, and process candidate information. You must comply with all applicable data protection laws, including obtaining necessary consents from candidates. You grant us a license to use candidate data solely to provide the Service.

5.3 Background Checks and Verification

You are responsible for conducting any background checks, reference verifications, or other screening processes in compliance with applicable laws. We do not verify the accuracy of information provided by candidates or employers.

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, functionality, and content, is owned by RecruitIQ and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our express written permission.

6.2 Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content solely for the purpose of providing and improving the Service.

7. Payment Terms

7.1 Subscription Fees

Certain features of the Service require payment of subscription fees. Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as otherwise stated in our refund policy.

7.2 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated to you in advance and will apply to subsequent billing cycles.

7.3 Payment Processing

Payments are processed by third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

8.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason we deem necessary to protect our Service or users.

8.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, subject to our data retention policies and legal obligations.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

9.2 No Employment Relationship

RecruitIQ is a platform that facilitates connections between employers and candidates. We are not a party to any employment relationship and do not guarantee job placements or candidate qualifications.

9.3 Limitation of Liability

To the maximum extent permitted by law, RecruitIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify, defend, and hold harmless RecruitIQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RecruitIQ operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
